Rights and Obligations of Foreign Investors in Algeria
Abstract
Foreign investments are considered one of the key drivers of economic growth, technology transfer and job creation, making them a strategic tool for comprehensive development in developing countries. In this context, the Algerian legislator, through Law No. 22-18 on investment, sought to establish a modern and integrated legal framework aimed at attracting foreign investors. This was done by granting them a set of rights and facilities, including tax advantages, sectoral incentives, institutional support and legal guarantees that protect their investments from risks, ensure legislative stability and safeguard investment freedom.
Conversely, this legal framework imposes a set of obligations and regulations on foreign investors including, respect for economic sovereignty, public health, the environment, labor law, principles of competition and financial and accounting transparency.
This legislative balance aims to protect the national interests of the host state while preserving the attractiveness of the Algerian market. It contributes to sustainable development and provides a stable and fair legal environment for all economic actors. The law falls within Algeria’s broader efforts to enhance investor confidence and reaffirm its commitment to transparency and economic openness as part of its national economic diversification strategy.
